MOTION FOR RECONSIDERATION/NEW TRIAL

Comes now defendant’s name, through his attorney, and petitions this Court for an order releasing him from the boot camp detention program and making appropriate disposition of his case, and shows the Court as follows:

1. defendant’s name was adjudicated unruly on a petition alleging truancy and placed on probation to the Court on _____________, 20 .

2.

On _____________, 20 a petition was filed in his interest alleging violation of that order of probation, in that he had not attended school as directed.

3.

On ___________, 20 , defendant’s name entered a plea to the unruly offense of Violation of Probation. On that date an Order was entered placing him in a boot camp program under O.C.G.A.§15-11-66(Exhibit "A").

4.

defendant’s name asserts that he cannot be housed in a secured juvenile detention facility such as boot camp based on the finding that he is unruly. This assertion is based on O.C.G.A.§15-11-48(e).

WHEREFORE, Petitioner prays:

(a) That this Court order defendant’s name brought before the Court for immediate hearing, or for release to his legal custodian until the Court can conduct a hearing;

(b) That, after a hearing, this Court issue an Order of Disposition on the unruly Violation of Probation;

(c) That this Court order such other and further relief as is just and proper.
